These Terms of Service ("Terms") govern your use of the website and services provided by SQWAFFLE ("we", "our", or "us"). By accessing or using https://www.SQWAFFLE.com, you agree to these Terms. If you do not agree, please do not use our site.

1. Use of the Website

You must be at least 16 years old to use this site as all buying and selling requires a PayPal account. You agree to use the site only for lawful purposes and in a way that does not infringe on the rights of others. 

2. Account Registration

Some features may require an account. When registering, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3. User Content

You may submit, upload, or display human-made artwork, comments, and other content ("User Content") on the site.

By submitting User Content:

  • You affirm that you own the rights to your content or have permission to share it.
  • You affirm that all content you upload or share on SQWAFFLE is entirely human-made and not generated by AI.
  • You grant SQWAFFLE a non-exclusive, royalty-free license to display and promote your content on the site.
  • You agree not to upload content that is illegal, infringing, offensive, or otherwise harmful and breach anything on our Prohibited and Restricted Items List.
  • You must not upload, post, or share any content that is false, misleading, or misrepresents your identity, qualifications, or the origin of your work. We may remove any content or suspend your account if we believe you’ve engaged in misrepresentation. We reserve the right to remove content that violates these terms.

4. Intellectual Property

All content provided by SQWAFFLE, including the site design, logo, text, and original artwork (excluding User Content), is our intellectual property and protected by copyright laws. You may not use, reproduce, or distribute our content without permission.

5. Purchases and Payments

  • All prices and fees are listed in the currency of your territory and are subject to change.
  • Payments are securely processed by third-party payment providers. 
  • Payout Schedule: Earnings for each SQWAFFLE are processed after the live SQWAFFLE has ended and paid out on the next scheduled payout, every Friday at 12:00 noon GMT.
  • All sales are final unless otherwise stated (see Refund Policy).

You are responsible for any applicable taxes or duties.

6. Prohibited Conduct

You agree not to:

  • Use the site for any unlawful purpose.
  • Attempt to access restricted areas or interfere with site operations.
  • Post harmful, fraudulent, or misleading content.
  • Infringe upon the intellectual property or rights of others.
  • Breach anything on our Prohibited and Restricted Items List.

7. Reporting, Moderation, and Enforcement

You may report content or accounts that breach these Terms. Reports are reviewed through automated and manual moderation systems. Where clear breaches are detected, the reported content or account may be hidden, restricted, or auto-blocked pending review.

False, malicious, or abusive reporting is prohibited and may result in suspension or termination of the reporting user’s account.

SQWAFFLE reserves the right to make final moderation determinations in its sole discretion.

9. Safety, Wellbeing, and Legal Compliance

SQWAFFLE complies with applicable online safety laws, including the UK Online Safety Act. Content promoting, encouraging, or depicting self-harm or suicide is strictly prohibited. Such content will be removed promptly, and accounts posting it may be restricted or terminated.

Where required by law, serious self-harm or suicide risks may be referred to relevant authorities or emergency services.

Prohibited Content Policy

Before uploading your SQWAFFLE offering, please ensure it meets our content criteria and complies with all applicable laws and regulations.

Review the list of prohibited and restricted items below to confirm your work is acceptable.

All SQWAFFLE offerings must follow these guidelines. Content that violates them will be removed without exception. Repeated or serious violations may result in suspension or permanent removal of your account.

These policies are based on relevant country and state laws and are updated regularly to reflect legal changes. It is your responsibility to ensure your SQWAFFLE offering remains compliant and lawful.

The following lists apply to all SQWAFFLE offerings, regardless of the medium or format.

Prohibited items

  1. Hate Speech and Discrimination. Content that promotes hatred, discrimination or glorifies violence or terrorism is strictly prohibited. This includes material targeting individuals or groups based on ethnicity, colour, disability, religion, sex, gender, sexual orientation, or regional origin. 

Examples include (but are not limited to): Historical slurs or racial depictions that are deemed discriminatory such as golliwogs and other such advertising media; Nazi propaganda; promotion of any proscribed terrorist organisation; images of the Confederate battle flag; antisemitic content.

  1. Promotion of Exploitation. Any content that depicts or promotes the sexual exploitation or abuse of minors (under 18), child sexual abuse material (CSAM), or any form of non-consensual or exploitative sexual content is strictly prohibited. This also includes material that depicts or describes extreme or graphic violence, including so-called “snuff” content. We maintain a zero-tolerance policy toward child exploitation. Any such material will be immediately removed and reported to the relevant authorities in the country of origin and/or as required by law.
  2. Personal Information. Content that discloses or shares another person’s personal or private information without their explicit permission is strictly prohibited. This includes (but is not limited to) names, addresses, contact details, identification documents, financial information, or any other data that could be used to identify or locate an individual.
  3. Offensive or Obscene Material. Content that is excessively explicit, vulgar, or otherwise obscene is strictly prohibited. This includes material that is illegal, pornographic, or intended to shock or offend.
  4. Plagiarised or AI-Generated content. Content must be entirely your own work. Plagiarized material or content generated by AI tools is strictly prohibited. By uploading, you confirm that your work is human-made, original, and that you hold the copyright. Violations may result in content removal and account suspension.
  5. Copyright Infringement. Content that infringes on the intellectual property rights of others is strictly prohibited. This includes art, music, writing, photographs, audio or any other work that is not your original creation. Violations may result in content removal and account suspension. 
  6. Trademark Infringement. Using someone else’s logo, brand name, or trademark to promote your own work without permission is strictly prohibited, except where permitted under fair use.

Note: These examples are illustrative and do not cover all prohibited content. Any content that violates the spirit of these rules may be removed.

Artistic Nudity. Artists have been depicting the human form for millennia, and SQWAFFLE fully supports the representation of the body in art. Content that depicts nudity in a purely artistic, educational, or culturally significant context is allowed, provided it does not violate other platform guidelines such as explicit sexual exploitation or obscenity. Such work must be flagged as Adult/Mature Content during upload.

Potentially Infringing Items

The following items may infringe on copyrights, trademarks, or other intellectual property rights:

  1. Intellectual Property of Others – Content that uses the work of others without permission, including counterfeits, replicas, or unauthorized copies, is not allowed.
  2. Bootleg and Unauthorized Recordings – This includes live recordings or performances made without the original artist’s knowledge or consent.
  3. Items Enabling Illegal Activity – Content that facilitates infringement of copyrights, trademarks, or other intellectual property rights is prohibited.

Note: Laws regarding intellectual property, discrimination, and other legal matters can change. SQWAFFLE may be required to remove content in accordance with applicable law or instructions from law enforcement.

 

DMCA Policy

SQWAFFLE – Digital Millennium Copyright Act (DMCA) Notice

SQWAFFLE respects the intellectual property rights of artists and creators.

We comply with the provisions of the Digital Millennium Copyright Act ("DMCA") and expect users of our site to do the same.

1. Reporting Copyright Infringement

If you believe that content on SQWAFFLE infringes your copyright, you may submit a DMCA takedown notice. Your notice must include the following:

  • A physical or electronic signature of the copyright owner or an authorised representative.
  • A description of the copyrighted work you claim has been infringed.
  • A description of the material you believe is infringing and where it is located on the site (include the URL or specific page link).
  • Your name, address, telephone number, and email address.
  • A statement that you have a good faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.

2. Counter-Notification

If you believe your content was removed or disabled in error, you may send us a counter-notification. Your counter-notification must include:

  • Your physical or electronic signature.
  • Identification of the content that was removed and the location where it appeared.
  • A statement under penalty of perjury that you have a good faith belief the content was removed or disabled due to a mistake or misidentification.
  • Your name, address, phone number, and email address.
  • A statement that you consent to the jurisdiction of the courts of England and Wales, and that you will accept service of process from SQWAFFLE or from the person (or their authorised representative) who submitted the original infringement notice.

We may reinstate the content if the original complainant does not file a court action within 10–14 business days of receiving your counter-notice.

3. Repeat Infringers

It is our policy to terminate, in appropriate circumstances, user accounts of those who are repeat infringers of copyright.

4. Important Notes

  • Misuse of the DMCA process can result in legal consequences. Only submit notices if you are sure you hold the rights to the content or are authorised to act on the rights holder's behalf.
  • We may share your DMCA notice or counter-notice with the involved parties as required by law.

 

UK Online Safety Act

Refund Policy

Effective Date: 16th October 2025

All digital content sales on SQWAFFLE are final once payment has been completed. Because digital files cannot be “returned,” we do not offer refunds, exchanges, or cancellations for any reason — including cases where the buyer has not yet, or never chooses to, download the purchased content.

Each Fan purchase includes up to three (3) download attempts per item.

Please ensure your device, browser, and internet connection are stable before starting a download.

If a download fails or becomes corrupted, contact support@sqwaffle.com within 7 days of purchase. Our team will verify your transaction and help restore access to your purchased files.

In the rare event that content is later removed for violating our Terms of Use, Content Policy, or applicable law, Fans retain any files already downloaded. However, refunds will not be issued under these circumstances.

SQWAFFLE reserves the right to suspend or remove content, withhold payouts, or reverse sales if required to comply with legal, regulatory, or ethical obligations, or to maintain the integrity of the platform.
